Terms of Service
Operated by Kerry Law PLLC (Michigan) (“Kerry Law,” “we,” “us,” “our”)
Effective Date / Last Updated: December 28, 2025
These Terms of Service (“Terms”) govern your access to and use of SmallClaimsNavigator.com (the “Site”) and any related content, tools, templates, downloadable materials, communications, and services offered through the Site (collectively, the “Services”).
By accessing the Site, creating an account, purchasing any product or service, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) What We Offer (And What We Don’t)
SmallClaimsNavigator.com provides small-claims-related self-help resources and services, which may include, depending on what you purchase:
educational information and guides;
templates, checklists, and filing/service instructions;
document preparation support based on information you provide;
optional add-on services (such as notary-related services and hearing-prep–type support), as described on the Site at the time of purchase.
1.1 No Guarantee of Outcomes
Small claims results depend on facts, evidence, court rules, and the judge. We do not guarantee any outcome, acceptance of paperwork, collection of money, or success.
1.2 No Court Deadlines Managed by Us
You are responsible for deadlines, filing requirements, service requirements, appearances, and compliance with court rules—even if you purchase Services from us.
2) Attorney Services vs. Self-Help (Critical)
Because Kerry Law PLLC is a law firm, some offerings may be legal services performed by a licensed attorney. However:
2.1 Self-Help / Non-Engagement Services
Unless you have signed a separate written attorney engagement agreement with Kerry Law PLLC for the specific matter, the Services you receive through the Site are provided on a non-engagement basis and are not legal advice.
Using the Site, purchasing a kit, or communicating with us does not by itself create an attorney-client relationship.
2.2 Attorney-Client Relationship Only by Separate Written Engagement
If you purchase an offering that includes attorney services (e.g., limited-scope attorney services), an attorney-client relationship is formed only when:
Kerry Law PLLC confirms acceptance of representation, and
you sign a written engagement/limited-scope agreement (and any required disclosures), and
any required fee is paid/clears.
If there is any conflict between these Terms and a signed engagement agreement, the engagement agreement controls for the attorney services.
2.3 Not for Emergencies
The Services are not for emergencies. Do not use the Site to seek help for time-sensitive situations requiring immediate legal action.
3) Eligibility
You must be at least 18 years old and able to enter into a contract to use the Services. By using the Services, you represent you meet these requirements.
4) Accounts and Security
If you create an account, you agree to provide accurate information, keep it updated, and maintain the confidentiality of your login credentials. You are responsible for activity under your account.
5) Purchases, Fees, and All-Sales-Final Policy
5.1 Pricing
Prices are shown on the Site and may change at any time. The price charged is the price displayed at checkout at the time you place your order.
5.2 Payment Authorization
By submitting payment, you authorize Kerry Law PLLC (and its processors) to charge your payment method for the total amount.
5.3 Delivery
Digital items may be delivered via download, email, portal access, or other means stated at purchase.
5.4 ALL SALES FINAL
All sales are final. No refunds, returns, or exchanges for digital products, downloadable materials, or services once purchased, except where required by applicable law or where Kerry Law PLLC, in its sole discretion, determines an exception is appropriate.
5.5 Chargebacks
If you believe a charge is incorrect, contact contact@smallclaimsnavigator.com before initiating a chargeback. Fraudulent or abusive chargebacks may result in account termination and denial of access to purchased materials and Services.
6) User Responsibilities and Accuracy of Information
You agree that any information you provide must be truthful and complete. You understand that inaccurate facts can produce incorrect documents or guidance.
You are responsible for:
verifying names, addresses, dates, amounts, and supporting documents;
ensuring filings and service comply with the specific court’s rules;
confirming current fees and procedures with the court.
7) Acceptable Use
You agree not to:
use the Services for unlawful purposes;
submit false or defamatory content;
attempt to hack, disrupt, or reverse engineer the Site;
scrape or harvest content/data using automated tools;
reproduce, resell, redistribute, or publicly post paid materials or templates;
misrepresent Kerry Law PLLC or the Services.
8) Intellectual Property
All content, templates, graphics, branding, text, and materials on the Site are owned by Kerry Law PLLC or its licensors and protected by intellectual property laws.
You receive a limited, non-exclusive, non-transferable license to use purchased materials for your own matter(s) and personal/internal use. You may not redistribute, resell, or create derivative commercial products from them.
9) User Content and Communications
If you submit documents, case facts, messages, or other materials (“User Content”), you represent you have the right to submit them and that they do not violate any law or third-party rights.
You grant Kerry Law PLLC a limited license to use User Content solely to provide Services, maintain records, improve service quality, comply with law, and enforce these Terms.
Confidentiality / Privilege Note: Communications are not automatically privileged unless and until an attorney-client relationship exists under Section 2.2.
10) Third-Party Tools and Links
The Site may include links or integrations with third-party services (payments, scheduling, chat, analytics). We are not responsible for third-party services and your use of them may be governed by their separate terms.
11) Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant uninterrupted or error-free operation, or that defects will be corrected.
12) Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KERRY LAW PLLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR LOSS OF GOODWILL ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF:
THE AMOUNT YOU PAID FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM, OR
$100.00
(except where prohibited by law).
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
13) Indemnification
You agree to defend, indemnify, and hold harmless Kerry Law PLLC and its owners, attorneys, employees, contractors, and agents from claims, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of:
your use of the Services;
your violation of these Terms;
your violation of law or third-party rights;
your User Content.
14) Termination
We may suspend or terminate your access to the Site or Services if we believe you violated these Terms, engaged in fraud/abuse, or for operational/security reasons. Upon termination, your license to use the content ends.
Sections intended to survive termination (including IP, disclaimers, limitation of liability, indemnity, and dispute terms) will survive.
15) Dispute Resolution; Governing Law; Venue
These Terms are governed by the laws of the State of Michigan, without regard to conflict-of-law rules.
Any lawsuit, claim, or proceeding arising out of or relating to these Terms or the Services must be brought in the state or federal courts located in Michigan, and you consent to personal jurisdiction and venue in those courts.
Pre-suit notice: Before filing a claim, you agree to email contact@smallclaimsnavigator.com with a description of the dispute and allow 30 days for informal resolution.
16) Miscellaneous
Entire Agreement: These Terms (and any policies referenced) are the entire agreement for Site/Service use unless superseded by a separate engagement agreement for attorney services.
Severability: If any provision is unenforceable, the remainder remains effective.
No Waiver: Failure to enforce a right is not a waiver.
Assignment: You may not assign your rights under these Terms without our written consent. We may assign these Terms in connection with a business transfer.
